Sun Baoshu said that since the promulgation of the "Labor Contract Law," the broad masses of workers and staff members have been very supportive, and most enterprises have actively and earnestly implemented them. However, in the implementation process, there are also three different opinions: First, it is believed that signing a non-fixed-term labor contract will lead to a rigid working mechanism; Second, it is believed that the implementation of this law will greatly increase the cost of employment of enterprises, so that enterprises It is unable to maintain normal operations. Third, it believes that the implementation of this law will affect the investment environment and employment.
Sun Baoshu said that these understandings are caused by the lack of a comprehensive understanding of the law. First of all, non-fixed-term labor contracts are not "iron rice bowls," nor will they lead to the rigidity of the employment mechanism. In order to use the energy of workers and workers, the "Labor Contract Law" proposes several situations for the termination of labor contracts. In fact, compared with the original "Labor Law", the conditions for the dissolution of the labor contract are still relaxed. For the second question, from the perspective of the system design of the "Labor Contract Law," the increase in the cost of employment in enterprises is very limited. The reason why the company believes that the Labor Contract Law increases the labor costs is actually because it has not fulfilled its statutory obligation to pay social insurance premiums for its employees, and the Labor Contract Law now clarifies these requirements. However, it is not correct to chase high profits at the low cost created by damages to employees’ legal rights, and it is unfair to those law-abiding businesses. Third, conscientiously implementing the "Labor Contract Law," and expanding employment and improving the investment environment is not only a contradiction, but a sound legal system and a harmonious labor relationship will further promote the improvement of the investment environment and expand employment.
